Negligent Security: Wrongful Death Settlement
Eight years ago the lives of my family were changed forever. My wonderful, bright, 23 year old niece was returning movies before there would be a late fee. She was carjacked and murdered. My sister, Lorri Papkoff-Brooks was almost catatonic in the year that followed. She could no longer work; she was on medication and was unable to find comfort in anything that she did. I knew that she wanted to bring litigation against the company that Amanda was returning the movies to. Neither she nor I had the energy to go forward with this. I mentioned to one of my children that nothing had been done and we were coming close to a year since this had happened. My daughter got back to me quickly to let me know that we could not file any charges after a year. With two weeks to go I was given Elliot's name by two other lawyers in Tucson. He realized the urgency and saw me within 48 hours of my call and by the end of the week everything was a go. After meeting my sister, Lorri, Elliot knew how difficult this would be and how emotionally frail she was @ that time. Never putting the outcome and possible chance of a court victory first, Elliot suggested that we go to mediation and not to court. He and I talked many times in the years between filing and actually going through mediation. Not once did he paint a picture that had greed or unattainable future in a conversation. Each and every time we talked Lorri was the most important thing and finding a way to solve the problem and not making her situation worse was in the forefront. Elliot helped me to secure a future for my sister, where if she can never work she will be OK. Elliot did that without damaging our family any more then it had already been. September 24, 2005 changed my family's lives forever. I was a victim of a tragic car accident in which I was critically injured and my husband was killed. I miraculously survived and in my long journey of recovery, I have incredible stories to tell. The one I am going to share with you is about a special person, Elliott Glicksman, who has helped me in ways he may not even realize.
I have to give you a little background first. My husband and I were coming home from renting a movie. We were five minutes away from home when a young man celebrating his 19th birthday drinking heavily at a party and on soma came crashing into us going approx. 90 mph. This happened at the intersection of Glenn and Mountain. The next morning my family was flown in from Chicago to take care of me and my two kids.
A few days later Homicide Survivors contacted my family as they heard of the tragedy and asked if they needed any assistance. They actually set up an appointment to meet with my family and Elliott happened to be present as he an active member. That is when my family found out that he was a lawyer and that he was already familiar with the case so they scheduled an appointment with him. Elliott was very experienced with dealing with large and intricate law suits and was willing to take our case. Both sides of my family found Elliott very personable, knowledgeable, and insightful and we agreed to retain him.
I heard Elliott came to see me while I was at ICU at University Medical Center, but being in a coma, I don't remember that part of my life. He came to visit me again at HealthSouth shortly before I was released in November of 2005. My family thought it was best I temporarily relocate to Chicago to undergo my therapy. Elliott's diligence continued. My family and I stayed in regular contact via phone and letters. One time, which I'll never forget, Elliott had to take a trip from Tucson to Milwaukee, connecting at Chicago Midway Airport, which is ten minutes away from where I was staying. My family and I took that as an opportunity to have him over for lunch. We also got a chance to catch up on some important issues. Elliott informed me it was only a matter of time before the other parties settled. It won't bring my husband back but it has given me financial security from the incredible medical bills and has provided funds for my for kids college education. I saw Elliott in a different light in Chicago - caring, funny, and down-to-earth. I also saw his concern toward those whose lives are entrusted to him. He always kept me informed of the progress of the case which eased my mind during this stressful time.
When I returned to Tucson six months later, I had more surgeries, more therapy and then the trial. With the support of family and friends I got stronger and stayed in touch with Elliott.
He encouraged me to give speeches along with him at various places on the dangers of drinking and driving. I agreed to that and we made a good team. He also set into motion my involvement with MADD which has become very rewarding for me.

Our son Tim was killed by a drunk driver on Oct. 1, 2000. Soon thereafter we began researching wrongful death attorneys. We interviewed numerous attorneys until we found one who seemed ok. Before too long, we realized our choice was wrong, so we began hunting again. One day, after yet another interview that left us discouraged and cynical about lawyers, we phoned Elliot Glicksman's office from our car. He was working on another case but said he could talk with us, if we didn't mind that he was dressed in jeans. As soon as we met Elliot, we both knew we'd finally found the perfect attorney.
Looking back on the whole process, we marvel at how Elliot kept things moving while juggling countless details. He was so good about keeping touch by phone, and the number of face-to-face meetings was just right. Elliot always explained what was happening with our case, as well as what we could expect down the line, and he did so with such skill and kindness.
Elliot was a bulldog when dealing with our adversaries, never giving an inch. He was completely dedicated to us. Elliot didn't even take the fee percentage to which he was entitled. At the time, because we were so consumed by grief and still in shock, the money seemed unreal (like Monopoly money), and we didn't fully appreciate this incredible gesture.
In 2002, we moved to the beautiful mountains of western North Carolina. Elliot's hard work on our behalf made this healing opportunity possible. We keep in touch with Elliot and his lovely wife a couple of times a year. Elliot remains passionate about his work, his family, and his friends, and his community service projects are too numerous to list. We are proud to call him our friend.
